Welcome to DockOps. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

These Terms apply to all users of DockOps, including managers, divers, and administrators. We reserve the right to modify these Terms at any time. Your continued use of the platform after changes constitutes acceptance of the updated Terms.

2. Description of Service

DockOps is a software-as-a-service (SaaS) platform designed to help hull-cleaning businesses manage operations, including:

  • Client and boat management
  • Job scheduling and tracking
  • Automated invoicing and payment processing
  • Diver management and pay calculations
  • Anode tracking and reporting

We reserve the right to modify, suspend, or discontinue any feature or functionality at any time without prior notice.

3. Account Registration

To use DockOps, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

You must be at least 18 years old and authorized to enter into binding agreements. Accounts may not be shared or transferred.

4. Acceptable Use Policy

You agree not to:

  • Use the platform for any illegal or unauthorized purpose
  • Violate any laws, regulations, or third-party rights
  • Upload or transmit viruses, malware, or malicious code
  • Attempt to gain unauthorized access to our systems or data
  • Interfere with or disrupt the platform or servers
  • Use automated tools (bots, scrapers) without permission
  • Reverse engineer, decompile, or disassemble our software
  • Resell, sublicense, or redistribute the platform

5. Subscription and Payment

DockOps is offered on a subscription basis. By subscribing, you agree to:

  • Pay all applicable fees for the plan you select
  • Provide valid payment information and keep it up to date
  • Automatic renewal of your subscription unless cancelled

Fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.

6. Cancellation and Termination

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We may suspend or terminate your account if you:

  • Violate these Terms or our Acceptable Use Policy
  • Fail to pay fees when due
  • Engage in fraudulent or abusive behavior

Upon termination, you will lose access to your account and data. We are not responsible for data loss resulting from termination.

7. Data and Privacy

Your use of DockOps is also governed by our Privacy Policy. You retain ownership of all data you upload to the platform. You grant us a limited license to use, store, and process your data to provide our services.

You are responsible for the accuracy and legality of the data you provide. You represent that you have all necessary rights to upload and process the data through our platform.

8. Intellectual Property

DockOps and all related intellectual property (including software, trademarks, logos, and content) are owned by us or our licensors. These Terms do not grant you any ownership rights. You receive only a limited, non-exclusive, non-transferable license to use the platform.

9. Disclaimer of Warranties

DockOps is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability, fitness for a particular purpose, or non-infringement
  • Uninterrupted, error-free, or secure operation
  • Accuracy, completeness, or reliability of content

We do not guarantee that the platform will meet your specific requirements or that defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, DockOps and its affiliates, officers, employees, and agents will not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from your use or inability to use the platform

Our total liability for any claim related to the platform will not exceed the amount you paid us in the 12 months prior to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless DockOps and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your violation of any law or third-party rights

12. Governing Law and Dispute Resolution
